1 Deposit and Payment Procedure
1.1 A deposit of 10% of the total holiday cost shall be paid (to be cleared) within 7 days of the booking. The remaining balance of the amount due is payable eight weeks before departure. If payment is by cheque, the cheque must be cleared at least 8 weeks prior to arrival. Bookings are valid after the owner has received an online form & acknowledgement issued by the villa owner.
1.2 A security bond of £250 ($400) will also be required payable ten weeks before departure, which will be held against possible loss, breakages or damage.
1.3 The security deposit (less any amount deducted for loss breakage's or damage) will be returned within 28 days of the end of the rental.
1.4 We reserve the right to increase the security charge.
1.5 The Client will also pay the full replacement cost of any damaged or lost item should such replacement cost be more than the amount of the security deposit.
1.6 Extra rental charges may be incurred should property repairs be required as a result of damage by the Client or their party.
2 Bookings Less Than 8 Weeks from Departure Date
2.1 In the event that a booking is made less than 10 weeks from the date of travel, the full balance will be due (to be cleared) within 7 days of the booking (as per Deposit payment procedure, above).
3 Cancellations
3.1 A deposit paid is non refundable, we reserve the right to cancel any bookings if the Client fails to pay the balance plus security bond by the due date.
3.2 The total cost of the rental will be forfeited if cancelled within 56 days of your departure date.
3.3 Cancellations made within the 24-hour period immediately prior to your arrival date are ineligible for any form of reimbursement.
We accept no responsibility for loss of night's rental in the villa due to flight delays or cancellations or any other circumstances. Travel Insurance is highly recommended.
4 Occupancy
4.1 A maximum number of 8 people are permitted to be within the villa at any one time and that this must not be exceeded under any circumstances. Failure to comply will result in loss of the security deposit and will be asked to vacate the villa without a refund.
4.2 The villa will be available for occupancy from 16:00hrs Florida time on the first day of rental, and must be vacated by 10:00hrs on the last day unless otherwise agreed.
4.3 If you require a late check out please contact our management company, they may charge $35 depending on the time. After 4 pm a full night rate may be charged.
5 Pool Heat
5.1 This should be requested in advance and paid for with your balance. However it is possible to request that it is turned on for a minimum period of 5 nights. Note: Pool heating is only intended to take the chill off the pool & not to raise the temperature to that of a bath or indoor pool. The maximum temperature is set to 84F for the pool and 100F for the spa. The heater will not function with air temperatures below 50F and in periods of cold weather it may not raise the temperature to 84F / 100F.
5.2 The guest will not be reimbursed if the night time temperature is below 50F for long periods causing the pool heater not to function.
5.3 Pool heaters are electrical / mechanical devices, and as such they can malfunction. If such an event arises every effort will be made to repair the fault. If the guest has paid for pool heat they will receive a refund for the number of days that pool heat was not available.
6 Children
6.1 You must ensure that children are not left alone in the accommodation at anytime. Neither are they to be allowed access to the pool unless accompanied at all times by a responsible adult.
6.2 You must ensure all door access to the pool area is kept closed at all times whilst children are in residence. Please note that it is an offence under Florida Law for anyone to tamper with, or disconnect the installed pool alarms.
7 Directions & Villa Details
7.1 Full directions and information regarding the villa will be sent to you at least 10 days prior to departure.
8 Management Company
8.1 You will be given details of our Management Company with your final confirmation. This is your point of contact for any problems or complaints that you may have during your stay.
8.2 Every effort is made to ensure that the property is in perfect condition for the duration of your stay. In the event that you find something missing or not working, please contact the Management Company immediately. When the Management Company have been notified of any failure, they will rectify the problem in a reasonable and timely manner.
8.3 During your stay, access may be required for maintenance by our Management Company and other authorized personnel. It is expected you will give reasonable access to such personnel.
9 Liability
9.1 Please note that the Owner, the Management Company and their respective Agents do not accept any liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however so caused. Under no circumstances are the Owner, the Management Company and their respective Agents liable for any consequential loss whatsoever.
9.2 The Owner, the Management Company and their respective Agents accept no responsibility for, and shall not be liable in respect of loss, damage, or injury caused by force majeure events. These include war, acts of terrorism, riots, strikes or other industrial action, airport closures, fire, flood, other weather conditions or any event beyond our control.
9.3 The Owner, the Management Company and their respective Agents will not accept liability for failure of any facilities / services at or to the property, however in the event of a problem our Management Company will endeavour to do everything within reason to rectify the problem.
9.4 Completion of the online booking form and/or full payment signifies acceptance of the stated terms and conditions.
9.5 Pets are NOT allowed. Smoking is NOT allowed anywhere inside the villa.If it is found that a guest has smoked in the villa or has brought a pet into the villa, the security deposit will be withheld by the owner to pay for a special deep clean of the villa.
9.6 WE STRONGLY ADVISE THAT YOU OBTAIN FULL INSURANCE COVER, WHICH OFFERS MAXIMUM PROTECTION AGAINST THEFT OF PERSONAL POSSESSIONS FROM THE VILLA, MEDICAL EXPENSES, TRAVEL AND CANCELLATIONS. SEPARATE INSURANCE COVER SHOULD ALSO BE OBTAINED IN THE EVENT OF THE CLIENT HAVING TO CANCEL THE ACCOMMODATION BOOKED.
THE OWNERS INSURANCE WILL NOT COVER THEFT OF POSSESSIONS FROM THE VILLA OR ACCIDENTAL DAMAGE OR PERSONAL INJURY.
9.7 We can arrange payments using credit cards, VISA and Mastercard only.
All payments must be in US$ only. We use a third party agency to carry out the transaction. If you choose to make any payment by credit card we will provide you with the forms to authorise a payment.
There is a $35 / £20 administration fee for using the credit card process. There are penalty charges if the transaction is for declined payments.
9.8 Prices and Terms & Conditions are subject to change without notice. No price changes will apply to confirmed bookings.
9.9 The Guest Will be liable for new keys and locks if the guest loses the main key to the villa.
10.0 Extended Rental Period
10.1 Should the rental period be extended at the request of the renter and by the permission of the homeowner, such permission to only be provided in writing, that all previously existing terms and conditions (with the exception of the rental rate for the additional period, which the owner is free to solely determine) agreed to by the renter continue to be in force, and that
1) full payment for the extended period is immediately due and payable,
2) the full security deposit must be maintained,
3) the security deposit may be applied to any unpaid amounts after the renter has vacated the property only at the discretion of the owner, and
4) the renter agrees to pay interest at 24% per annum plus any and all collection costs necessary to recover any unpaid amounts due.
